In a recent case highlighting the severe consequences of ignoring health and safety regulations, a 59-year-old company director has been sentenced to eight months in prison for his role in the illegal removal of 10 tonnes of asbestos-containing material from a building in Hampshire. The incident occurred during a project to convert a commercial unit on Winnall Close into student accommodation.
The sentencing, delivered at Southampton Crown Court, followed a thorough investigation by the Health and Safety Executive (HSE). The director’s co-director received a four-month suspended sentence, and their company was fined £30,000 for their role in the illegal activities.
The court was told that the company, a single-purpose vehicle created solely for the refurbishment project, initially sought quotes for the safe and compliant removal of asbestos insulating board (AIB). However, instead of adhering to the necessary safety protocols, the directors chose to cut corners. According to the HSE, they opted to save “a considerable sum of money” by hiring “unqualified” workers who were “unaware of the risks to their health.”
The HSE criticized the directors for knowingly exposing workers to significant health risks. The investigation also revealed a disturbing detail: the final whereabouts of a large quantity of asbestos-contaminated debris remain unknown, potentially putting others involved in the waste removal process at risk as well.
All three defendants admitted to charges under the Health and Safety at Work etc Act 1974, specifically relating to the inadequate management of asbestos removal.
HSE principal inspector Steve Hull commented on the case, stating, “Despite the directors of this company being put on notice of the risks involved, they put profit before the health of those they employed. The dangers to health associated with exposure to asbestos fibers are well known, and a wealth of advice and guidance is freely available from HSE and other organizations.”
Hull emphasized the importance of adhering to strict safety guidelines when dealing with asbestos. “Structural refurbishment that either exposes or is liable to expose people to asbestos fibers should only be carried out by competent persons working to a strict plan of work to ensure safety. Higher-risk asbestos removal, such as the removal of AIB, can only legally be carried out by licensed asbestos-removal contractors who have the knowledge and equipment to prevent the spread of fibers and properly protect the workers undertaking the removal work.”
